Wallhangers in Victoria

Post by Wombat » 28 Dec 2017, 6:27 pm

Just for information, if you are Victorian and want to display a firearm over the fireplace etc its a non starter for anything Cat A or B etc, however you are able to put an "Exempt Firearm" anywhere you like. Exempt Firearms according to Victoria Police are-

What is an exempt firearm?
A firearm is exempt from regulation if it was manufactured before 1900 and meets the following criteria:
Handguns – a) its method of ignition pre-dates the development of ‘percussion’* or
b) is a single shot antique handgun
Longarms – a) it does not take cartridge ammunition or
b) if it does take cartridge ammunition, that ammunition is not commercially available.
*Percussion means a means of ignition in a firearm in which metallic chemical compounds or fulminates are
used to ignite the main powder charge.
Examples of exempt firearms
Exempt firearms include pre-1900
muzzle and breach loading firearms
such as flintlocks, matchlocks, wheel
locks, snaphances, caplocks,
inoperable military cannons or field
guns, cannon net devices and remote
controlled model warship cannons.
Regulation and licence requirements
As these firearms are ‘exempt’ from the Firearms
Act 1996, there is no regulation or licence
requirements to purchase, possess, carry and use
exempt firearms in Victoria

Just posting as this doesn't appear to be common knowledge (and I understand is different to other states) :allegedly:

G'day Wombat,
Well known amongst Collectors, but not as well amongst the general community I agree. One thing I must point out is in your 2nd last line, the term "use". You must not fire the device or it becomes a firearm under the definition of the Act, and you can be prosecuted. Buy them, study, display and enjoy, but if you want to "use" it then get it registered first, Cheers.

But heres the thing when they talk about commercially available how do you define that, cause maybe theres one manufacture in USA that imports into one shop in Victoria that no one may know about?

Yes, however that wasn't my writing -it was copied from the Victorian Police website, the "what is a firearm" PDF linked off this page-

I think Victoria police define that.

G'day pete1,
VicPol have a list of calibres that are considered obsolete on the definition of no longer being manufactured by a major company AND being available for retail in Australia. Your possible scenario doesn't work as all ammo is imported under licence and if anyone imported it for sale, the Police would know beforehand. There are a few manufacturers of this type of ammo here, but the Police consider them to be "Specialist for Collectors" rather than "Commercial" due to the very low volume and lack of a distribution network, though recent talks with LRD have indicated that a couple of calibres may be removed from the Obsolete list due to this activity, Cheers.
