Now hang on, perhaps I'm wrong but if it looks real don't you need a collector's licence or something?

If it looks real you would need some sort of licence for it, I don't think this one looks real enough for that though :-)

Note to ALL VICTORIANS,
This is an "Imitation Firearm" by definition of the Act, and you MUST HAVE a Prohibited Weapons Approval or Governers Exemption to own it. There are also storage requirements for these items under the Act. If you are caught by the Police in possession you will lose your Licence, BE ADVISED!! Don't start 2018 in the poo. Read the VicPol website regarding Imitation Firearms before you buy this "toy", and if you already have, join a Collectors Club, pronto. Cheers.

Vic Pol PDF regarding imitation firearms and your obligation to have the correct permit can be downloded from the website, VicPol - Our Services - Firearms - Reference Information. I repeat my warning from the previous post, YOU NEED A PERMIT! And comply with storage and display conditions, don't start the New Year by being prosecuted, Cheers.

I think it would be very silly to buy one without checking legals first. You can't plead ignorance when you get a knock on the door and they take all your firearms

The actual received item is supposed to have a red thing in the muzzle and trigger area to make it a toy. That's what the description tells me. I will let you know when it arrives.

How on earth does this qualify as an imitation firearm?
It barely resembles any kind of firearm.

Not since 2011, a red muzzle plug no longer differentiates it as a toy.

Paint the stock bright pink or yellow, it's a toy, as it is, it's an imitation firearm. The one and only thing I can see that might save it is the actual length of 550mm being small enough to pass the "reasonable person" test. I will wait and see what LRD have to say in response to bladeracers query, but I would not risk a lifetimes collection on what I see at the moment. I have been advised by a friendly DFO in the past to paint my spud gun from black to bright red to avoid the imitation firearm trap. With LRD lately being "zero tolerant", you risk a great deal for a piece of plastic. Only with an official, or at least attributable, answer to bladeracers email would I buy one of these, Cheers.

Perhaps, but it does say "The responsibility for determining the status of an object at all times rests with the individual in the first instance and ultimately the courts." Which individual are they referring to - the owner or the LEO?
I may get an opinion from LRD that they think it's legal, but a LEO could still choose to ignore that.

My opinion is that it complies with being a toy under everything I can see.

"they are solely manufactured and used for the purpose of being used as a plaything or for providing amusement"
"their method of operation...falls outside the definition of a firearm in the Firearms Act 1996"
""their appearance cannot be mistaken for a working firearm by a reasonable person"

There lies a problem "reasonable person" you are making a judgement from a knowledgeable firearms owner. try and put yourself in the shoes of an 80 year old granny with bad eyesight. Or a young just out of giggles 18 year old blonde girl. Have you seen some of the young on TV these days some are real clueless.

No, might need to get it registered and then hand it it for destruction.

Response from LRD just now:

"Thank you for your email received by Licensing & Regulation Division on 2nd January 2018.
Please be advised that given the overall length of this item, this item is considered a toy in Victoria and not an imitation firearm.
Should you have any further enquiries in relation to your e-mail, please direct them to licensingregulation@police.vic.gov.au "

Good news, looks like the only exception I could think of, the overall length, is what LRD have determined. Nice to see a bit of common sense from them given how nuts they've been lately. Might have to buy one myself now, can go on the wall next to the obsolete bolt actions seeing as we are not allowed to display deactivated here. Cheers
