GoPro dash cams legal?

Post by sarki » 18 Feb 2015, 5:57 pm

Bit of a weird question but how about it?

Any privacy laws or anything that might technically make them illegal if you don't have a passers by permission to film etc.?
Dear Santa,
Please bring me a Desert Tactical Arms SRS-A1 Rifle in .338 Lapua Magnum.
I'll be good with it, I promise!

Yep legal.

They're out in public, you have a clearly visible camera and aren't making any attempt to hide it or covertly film them.

Go for it.

FYI from the Arts Law website Australia:

People do not own copyright in their own appearance or image and it is not an infringement of copyright to film or photograph people. Further, public figures or celebrities do not have any special rights to privacy in Australia. This means that film makers and artists filming in public have no need to be concerned about the concepts of ‘rights to privacy’, ‘personality rights’, or ‘image rights’ in a strict sense here.

AFAIK the only exceptions are common sense things.

You're not allowed to knowingly continue to film a crime (allowing it to happen without reporting it)

Not allowed to be a nuisance or obstruct anyone to take your pictures

Those kinds of things.

There are enough d**khead drivers around my area I've taken the plunge today.

I have a GoPro put aside at a store to pick up on the way home, going to be used as a dash cam.

Was that seriously on last night? :lol: No, I hadn't see that.

Did a quick google, found this on a QLD lawyers website crlawyers...

In Queensland a person has a right to film in public, except in some very limited circumstances which include:

1. Where a person is making indecent visual images of a child under the age of 16;
2. Where a person is committing an indecent or offensive act in public;
3. Taking of prohibited visual recordings of adults;
4. Where the person is being a public nuisance whilst filming; or
5. Where the person is obstructing police whilst filming.

I haven't got anything else to quote, do some more searching yourself I guess if you're really interested, but I think there are various forms of that from state to state. Don't have the exact details it was just a segment I heard on the radio a while ago.

Wish I had bought one a few weeks back.
I had a semi pull across in front of me from where he was parked illegally (on the wrong side of the road and facing the same way that I was travelling)

The nose of my vehicle was level with his prime mover drive wheels, when he pulled out (obviously without checking his mirrors first)

The bar supporting his mudguard over the drive wheels hooked into my bulbar, and twisted my bulbar forward and downward, and then pushed the nose of my vehicle sideways approximately 2 feet.
By that time I was on the horn, and only then did he stop (and then look in his mirror)

I reversed out from under his mudguard, and back across onto the left side of the road where I stopped.

The semi then reversed back well past me into an open area on the right, where I thought he was going to park, and come see me.

Silly me,,,,,,,,,,,,, he then grabbed a gear and drove off and left me.
By the time I traced the trucking company and rang them I was greeted by the rudest person I've ever spoken to.

He told me that it didn't happen, and there is no way I can prove anything.
:huh: :huh:

I didn't in the end, not yet.

I got to the store yesterday and they'd made a mistake. I'd asked them to put aside a Hero3 White which they say they had. They're $270.

Found out when I got there they now gone and everyone's only stocking the Hero4. The Hero4 Silver (cheapest model) is $549 though :(

I'll probably still get it, but the shock of the price doubling put me off getting it on the spot until I gave it some more thought.

90% sure I'll still get the silver in the next few days.

Nah matey,,, I never had much luck nor faith when it came to constabulary.

I'm going to deal with it differently and personally.

Truck parking bays don't have "Go Pro" cameras.

No need to be spending big $$$. I have one of the ambarella-chip mini cams and they are more than fine. 1080p and no trouble seeing number plates, etc. Usually about the $100 mark and unobtrusive near the mirror, not cluttering up your vision. Removable and software included. Here is one seller at random, but do your own ebay search - http://www.ebay.com.au/itm/HD-Dash-Cam- ... 1541&rt=nc

I know there are cheaper options which I'm sure are good in many regards. I do want to do more with it though than just run a dash cam.

GP quality is great from what I've seen, also the waterproof housing, wide array of mounts etc. etc. Figured it best to buy the one that will do all and last me forever (hopefully).

Buy once, cry once.
