Reasonable excuse for discharging a weapon in public

Questions about Queensland gun and ammunition laws. QLD Weapons Act 1990.

Reasonable excuse for discharging a weapon in public

Post by brisb » 20 Aug 2014, 11:03 am

I'm reading up on some shooting laws and found this (the bolded bit's the important bit)

Sections 57 of the Weapons Act Queensland states:
In this section-
weapon includes-
(a) an antique firearm, spear gun, long bow or sword; and
(b) a replica of a weapon; and
(c) a replica of a thing mentioned in paragraph (a); and
(d) a slingshot or shanghai
A person must not, without reasonable, carry a weapon exposed to public view in a public place
A person must not, without reasonable excuse, carry in a public place a loaded firearm or a weapon capable of being discharged.
A person must not, without reasonable excuse, discharge a weapon in, into, towards, over or through a public place

What would be a reasonable excuse? :?

Self defence was the only thing I could come up with but that's not allowed here anyway so left me wondering. Ideas?

Putting down injured animals and stock on roads and such I would guess.

Say you're driving somewhere to go hunting and you hit a roo so you put it down with the .22 or something. Of course you would be required to do so in a safe manner.

This came up on another forum a few years ago. At that time the law said you had to get to the nearest vet and get them to come out and put it down. Crazy huh.

i hate the tire iron!!! i had to do it once to a roo that i nailed coming down from the ski fields. i was not very happy about doing it, but had no choice. would have been much easier with a 22!

lol, nah mate, i was in the family wagon and she already dented my front guard, so wasn't about to risk any further damage!.

i dropped the kids back to the accommodation, tried to find a shooter, but to no avail, so went back and finished her off with the tire iron. i found it really hard actually. i'm not a fan of animal suffering, so it wasn't an easy job for me! (I'm a city slicker! lol)

A 22 (or your truck!) would have been sooo much easier!

she was very f'd up - never seen a kanga bounce so much without using her feet!! She was only going to be fox bait, so felt the only right thing to do was give her the tire iron

Good logic right.

"How to humanely dispose of a suffering animal: Make it lay wounded on the road for an hour and a half while you got find someone else to euthanise it for you."

-1

If the situation requires it and you're willing and able, you should be able (encouraged) to just do it.

I wouldn't say that's entirely correct.

About 2 years ago or thereabouts there was an incident where some junkie was choking the life out of his landlord for some drug induced reason.

A neighbour got alerted to the situation after a minute, had his rifle nearby so grabbed it and shot the bloke from a distance saving her. Last I read around the time no charges were pressed.

I hear you though, it's a high threshold to prove self defence.

Like the bloke who shot someone breaking into his factory property recently, he's arguing self defence except he was at the upstairs window inside and the guy was outside breaking through the fence outside. I reckon he's toast.

Yea, it's pretty iffy.

Though I think most sane people would take a few years jail time for using a firearm in self-defence if their life really was in danger.

Wasn't there one recently too where someone was being attacked by a dog and the neighbour shot the dog off?

I don't think he got charged either, last I heard at the time anyway.

I think I know the one. Might have been 18 months ago and he shot it from across the road with his rifle.
