Bequeathing firearms

Post by perentie » 29 Dec 2024, 4:39 pm

When my wife died, as the beneficiary, all her firearms were automatically transferred to my licence. No PTA required.
Now its nearly my turn and the Beneficiary does not have or want a Licence.
I know who I am going to leave all my firearms to and they have a Licence.
Will the firearms get transferred to their Licence automatically or will they have to apply for a PTA for each one.
Thoughts.?

Yes a PTA will be required if it is on the new persons firearms licence. A dealer will have to do the acquisition and fill out the form 10. You can only loan a firearm if licensed for it for 3 months legally without acquiring it(PTA).

However this new owner can apply for an heirloom collector licence if they wish and hold the firearms on that licence.

My understanding is that your will should mention this specifically.

I just went through this 3yrs ago, so unless it's changed in the last 3yrs.
As a beneficiary no PTA is required, however a genuine reason is.
My uncle died suddenly and I live in the same rural area and was present at the scene with local police.
I told them i would take possession of firearms until will was read.
I think we had to provide copy of will to WL with genuine reason and that was it.
I have no love for WL but this was one occasion where it was a simple logical process.

This is pretty much the procedure, but a couple of other documents are needed, one is an Indemnity Receipt, which can be downloaded from the Qld Police website, a letter from the Executor of the Estate requesting the transfer, a copy of the Death Certificate or other official document proving death. There is info on the Qld Police website to guide you or as bigrich said, talk to a lawyer who understands firearms, a cheap cost to get everything right.

Thanks for all the replies. Looks as if we are good to go then. They are members of our club and I have already given them a few (via PTA) so its only the ones I am using that are left.
