its a f ing joke these little s**ts know exactly what they are doing ,but the legal system defends and lets them hide under different excuses ie black/disadvantaged/bad upbringing blah f ing blah ,,start to make the parents abit more responsible,,
the same things have happened with car theft and young teens where i live ,they get away with murder ,,and get treated differently because of skin colour or having a disadvantaged upbringing ,,
it all went down hill when they abolished the cane from school and made smacking your kids a bad thing ,,it taught you the meaning of consequences for your actions

Yep ! and if you got the cane at school you did NOT tell your parents when you got home or you would get wacked again for being "bad" at school.
I do not believe we were hard done by, we were disciplined and learnt right from wrong.

THAT'S WHAT'S MISSING IN MODERN SOCIETY ! if a head master gave a kid the cane now he'd be on charges , and the poor little pettle would be sent to therapy to deal with the trauma . FFS . i hope if ON wins power in this country they make it policy to put a little concrete into all the kid's breakfast cereal's , and reintroduce the cane at at school :D

The fact that she was using "doli incapax" and looking up the penalties is (in my non-legal mind) primae facie evidence she knew it was wrong.
Magistrates need to be replaced.

What does the Beak have to do with it? They have to obey the Law same as everyone else and if the Law says the brat is too young then the Magistrate CANNOT overturn the Law. The hypocrites in Govt mouthing platitudes of "Adult Crime, Adult Time" and other such tripe from Allen and her cohorts whilst they are the ones who introduced this garbage Law and refuse to rescind it are the problem that needs to be excised. The Coalition is so fractured by egotistical backstabbing faction feuds that they cannot present a viable alternative, and One Nation splitting off the more Conservative votrs from them, a Labor victory is assured and so nothing will change.

Another reason why I hate everything about modern Australia. This country sucks. We all know it.

Pauline is our last hope. If things do not change soon then this country is gone.

Dead right.
But the country is full of peanuts still voting "like dad told me to do" regardless of the mentally deficient parasites that infest the trip-opoly now.
Even when their kids are all destined to live in tents and they start executing people once the reach 70 to make up for organisational incompetence, they will still vote their way over the cliff.
And even if we resist them taking us with them, the commo dogs will legislate that we will do so or else.
"The only way to avoid criticism is to do nothing, say nothing, and be nothing."
Aristotle.

The beak decides if the accused is capable. Legal age is one thing, but a 40yo with severe brain damage may not be legally responsible.

There are hard and fast rules in various states about legal responsibility (a 5yo is not legally responsible), but the gray zone is where the beak decides that a 13yo committing pre-meditated acts, then urgently checking the penalty for the act is somehow not ABLE to understand that what she did was wrong.

Meanwhile, whenever a grub gets killed during their own criminal act, the media says it went WRONG. Sounds like Victorians are finally making home invasions go RIGHT.

My 13-year-old son knows that doing wrong means losing his favorite privileges, like fishing, gaming, or coming to the range with me and other things. Thanks to those clear boundaries, he stays well-behaved at school and home. He’s still a normal, mischievous boy, but he avoids the serious trouble so many kids get into today.
