I'm stuck inside of a paradox

Last night I got into a bit of a debate with somebody about my roster.
Neither of us could come to an agreement due to the fact that we we're both right and wrong at the same time, therefore confusing the s**t out of ourselves.
It wasn't until after I knocked off that my head stopped hurting and I could clearly see the answer.

I'm posting the problem here, just so that I could make other people suffer, as we did :twisted:

For truck drivers, the law states that over a 7 day period I can only work for a maximum of 72 hours and must have a continuous 24hr break.
Shifts are like so:
Night shift one week, day shift the next, night shift the week after that and so on.
Night shift = 4pm - 4am Sun, Mon, Tue, Wed, Thu, Fri
Day shift = 4am - 4pm Sun, Mon, Tue, Wed, Thu, Fri, Sat
No work between 4pm to 4am starting from Saturday afternoon


My argument was that I work 72hrs a week and have a continuous 24hr break over 7 days.
His argument was that for day shift, I work for 84hrs and do not have a continuous 24hr break over 7 days. Therefore exceeding the legal working hours.

What do you see?? (Using your head only, neither of us had any 'visual aids' at the time)

Not really. An average hour consists of:
Drive for 8 minutes
On the loader loading the truck for 7 minutes
Drive for 12 minutes
Surf the net, chat, read paper etc while waiting to be unloaded for 23 minutes
Watch truck being unloaded for 10 minutes
Rinse, repeat, knock off.

Total distance traveled over a 12hr shift is ~74km. Not once have I looked at the time and thought "Bloody hell, 6hrs to go".

The 23 minute waiting time is an average. It can go from 0 to 90 depending on how many other trucks are waiting.
I average 11 round trips over a 12hr shift, so any missing time is time waiting.
The most number of trips I've done was 15, that was with almost no waiting time at all.
The most number of trips that I know of was 22, that was when they had a dedicated loader driver and almost no waiting at all. (only 5 of the 11 trucks were running that day)

Yeah mate, you are exceeding the "legal" working hours by 12 hrs a fortnight.(max 144hrs)

Are you driving more than 100km from the deppo ?

If not then it doesn't really matter. You aren't required to fill out your log book.

The hours still apply whether you have to fill in a log book or not. It is illegal for the company to ask a driver to exceed maximum hours. Payslips will show that he is exceeding the hours.

You're doing seven continuous day shifts - which is 84 hours?
