Homeowner charged: the reply from the pollies about "castle law" was that, in QLD, we have the criminal code which allows defence of self/dwelling.
HOWEVER, there is a real risk of being charged, as the use of a gun = possible lethal force, and would be seen by the letter of the law as disproprortionate.

If 6 ICE-crazed, armed thugs enter the house, a cricket bat is not going to make you into Rambo, so the castle law petition was meant to even this nonsense up.

So: NSW residents, start a petition for castle law, specifically demanding that the ambiguous "reasonable force" BS is removed, so that blokes like this homeowner don't need to defend themselves again in court (I'd rather face the thugs than a lawyer).

The general public in NSW should be outraged that police would see fit to lay charges.

Here, we have a 75 year old man, who has already been stabbed, and fearful that the assailant (said to be 34 years old) might return and inflict further harm, has retrieved a firearm so as to defend himself and another (72 y/o wife), with reasonable force.

With such a miss-match of physical ability between a 75 and 34 year old, I would think that a firearm might have been the most practical defence.
(That guy should have been transported to hospital very slowly. Wouldn't want to exacerbate his injuries, would we.)

didnt say anything about the home owner being charged ,only the offender
but its not going to surprise me ,, the old fella was defending his wife and home even after being stabbed from a lowlife POS ,,surely or should i say hopefully common sense will prevail and the old fella has nothing to answer for,, and the offender dies a painful death

He will still lose his shooter's license I'll lay money on it just like that other bloke a fair while ago the filth came back at him weeks or months later took everything and he's licence for breach of licence conditions.
