How can she be let off with this?

'Put that in your pipe and smoke it': Woman's Facebook boast after she was charged with having NINE guns in her car - but got off due to 'insufficient evidence'

A young woman allegedly caught driving with a stockpile of weapons in her car has celebrated on social media after all charges against her dropped due to 'insufficient evidence'.
Bianca Micallef, 23, appeared in Broadmeadowns Magistrates' Court - about 20 kilometres north of Melbourne, where all changed against her were thrown out.

The 23-year-old fired back at police on social media after walking free from court, posting: 'All charges withdrawn/dropped ... PUT THAT IN YOUR PIPE & SMOKE IT!!,' according to the Herald Sun.

Victoria Police had earlier alleged nine firearms including a sawn-off rifle, non-sawn-off rifle, a pistol, two revolvers, a pump-action shotgun and double and single-barrel shotguns, along with an amount of ammunition, had been discovered in a car being driven by Ms Micallef in Sunbury, north-west of Melbourne, on March 3.

That's insane!
I wonder what would happen to me if a took an extra rifle to the range without a suitable bag or case!?!

So a 23 year old female can drive around with a unregistered armoury while if i don't transport my legal, registered, rifle i'd get the book thrown at me... seems legit

They were in the front and back seat of HER car, which means SHE was in possession..... Absolutely gob smacked!!!

How is carrying these firearms 'insufficient evidence'? They were in her car and she was caught, any of us would be f****d in the ass if we were caught with half of these! And she bragged on Facebook about being let go

A lack of evidence. ... that's beyond belief,

I bet the police involved won't be happy, I'll also bet that they'll be watching that self obsessed criminal and her associates very closely, she won't be able to J walk without copping a pineapple from now on.

Probably insufficient evidence because they weren't registered, so they couldn't prove she owned them.

I just cannot understand it. I'm seriously dumbfounded. The police should be appealing this.

Gotta link to a local paper? Bit suspicious it's only made the media after going to court, why not when she was pulled over? You'd think with all that alleged firepower it'd be all over the news yet this is the first many of us have heard of it. Papers get stuff wrong constantly, "Phuc Dat Bich" being a recent example..:)

Pump action shotgun looks like a rifle stock, revolver AND a handgun so obviously this Liam dude is clueless...Understandable that journo's make mistakes since it's one of the lowest paid jobs and has a very low entry score to study at Uni not to mention many journos are chronic drinkers.

This is indeed very interesting, seems yet another 2015 VICPOL OWN GOAL!
Request for transcript sent - this will be very telling, but I suspect she claimed no knowledge of the arms, maybe multiple persons had access to the ve-hicle, HENCE poor mr Vicpol gets no cookie...

It is ironic, nay, shameful, that a licensed shooter, with firearms registered in his her name, would indeed be reamed upon entry to the court as the mere registration would prove ownership/possession etc....

Section 4A of the Firearms act 1996 states you're in possession of it if it's in your premises,vehicle,vessel or aircraft.

I can't possibly see how this would not apply to all residents, citizens and subjects of Her Majesty in the Commonwealth of Australia.

FIREARMS ACT 1996 - SECT 7C

Possession of a traffickable quantity of unregistered firearms
(1) A person must not possess more than 10 firearms that are not registered.

Penalty: 1200 penalty units or 10 years imprisonment.

(2) Subsection (1) does not apply if, in respect of any one of the 10 firearms, the person has given a notice to the Chief Commissioner under section 115.

S. 7C(3) amended by No. 12/2012 s. 9.

(3) A person who is convicted or found guilty of an offence against subsection (1) is not liable to be convicted or found guilty of an offence against section 5(1), section 6A(1), (2) or (3) or section 7B(1) or (2) in respect of possession of the same firearms at the same time.

S. 8 amended by No. 22/1998 s. 43(Sch. item 1).
