Making my own magazine

Questions about Queensland gun and ammunition laws. QLD Weapons Act 1990.

Making my own magazine

Post by Blu333 » 10 Jun 2014, 6:50 pm

Hi Guys,

If I had the equipment to make my own billet magazines would I run into any legal problems if I did.

I can't see it really being a problem as its not a receiver, barrel etc. I'm in Queensland if that makes a difference.

Cheers

You may need to check the regs to see if you need a manufacturers license mate, or drop them an email. But it would be a cool project I reckon.

You need a licence to buy a magazine in QLD right?

Says to me making your own is probably not on?

Email QLD Weapons Licensing and get a written reply, but...

Other than showing your license when you buy they're not recorded, correct?

No serials, no database anywhere, no limit on how many you can own?

Might be no prob then?

Magazines ARE controlled in QLD...

Depends if you own the rifle that fits the mag and capacity.....best you familiarise yourself with the Weapons Act, and sec68(var) of the regs...

I would assume a dealer has to site your license before they allow the purchase, to make sure you have a licensed firearm that will accept that magazine... I mean what would happen if people thought they could just buy any old bit of steel with a spring it :o

Mags are not a registrable component, but there are many offences involving the possession.... have a read of the regs;
https://www.legislation.qld.gov.au/LEGISLTN/CURRENT/W/WeaponsR96.pdf

You effectively require a licence (reasonable excuse) for any cat A/B magazine, for Cat C/D/H a licence, so technically possession of, for example, an AR mag REQUIRES a Cat D licence.

Yes I know there are thousands of such mags in QLD in use with cat B rifles, well the lawmaker have you by the nads, as they could use their discretion to hit you all with $1,100 fine (110? pen unit).

If your mag does not fit a cat D and you stay within the mag limit you'll be fine...

68CA Prohibition on possession of particular magazines—category B weapons
(1) This section applies to the holder of a firearms licence who is the registered owner of a category B weapon under the licence.
(2) The holder must not possess a magazine—
(a) if the category B weapon has a lever or pump action—with a maximum capacity of more than 10 rounds for the weapon; or
(b) if the category B weapon is a repeating centre fire rifle—with a maximum capacity of more than 15 rounds for the weapon.
Maximum penalty—10 penalty units.
(3) However, subsection (2) does not apply if—
(a) the holder is the registered owner of a category D or R weapon, held under another licence, in which the magazine is able to be lawfully used; or
(b) a condition of the holder’s firearms licence authorises possession of a magazine with a maximum capacity of more than 10 or 15 rounds.
68D Prohibition on possession of particular magazines—category H weapons
(1) This section applies to the holder of a concealable firearms licence for sports or target shooting who is the registered owner of a category H weapon under the licence.
(2) The holder must not possess a magazine with a maximum capacity of more than 10 rounds for the weapon.
Maximum penalty—10 penalty units.
68E Prohibition on possession of certain magazines
Subject to sections 68CA and 68D, a person must not possess—
(a) a magazine for a category C, D, R or H weapon unless the person holds a licence under the Act; or
(b) a magazine for a category A or B weapon unless the person has a reasonable excuse.
Maximum penalty—10 penalty units.

Once you have the regulations sorted the building is another matter.

I have built one for a hornet and it was a adventure, third one one was close and the forth one functioned and fit well. There was lots of measuring and tweaking.

I did not have anything to go by and had to design it from scratch. There is a lot that goes into a mag and we all know what it is like when you have an unreliable one. Have fun.

Yup, never underestimate what politicians can think up if there is a headline in it ... And if they wont even allow us a bill of rights.
