FIREARMS AMENDMENT BILL 2021

Questions about Western Australian gun and ammunition laws. W.A. Firearms Act 1973.

"find it a very simple defense, it should be sufficient for the Police to drop the case before it goes to court"

You hope.

My understanding is there have been a fair few convictions for just cases laying around.

Bladeracer I would not be so confident if I was you. (unless your a WA lawyer specialising in firearms)

It's fine to interpret this stuff if you want, we all do that. But in the court it could easily turn out to be wrong. And then there is "case" law.

"Prosecutors hate this one simple trick! Open this link to learn how to play WAPOL at their own game!"

Mate if it was that easy, people wouldn't have been getting done for this, not infrequently, for years. If anyone stands up in court, with case law precedent behind them, and says that a case is not a "component of ammunition", it's not the Police that will get laughed out of court.

The proposed definition is lightyears better than the current one. I dislike most of the amendments but not that specific one.

They should get laughed out if that was their defense :-)
Their defense would be "A cartridge case does not fit the legal definition of an ammunition component. It is not a primer or a propellant and is not discharged from a firearm."
Are you aware of anybody that has tried such a defense and failed?

I would hope a judge understands English.
Having spent most of my life in WA I know they will and do use any possible trick to prosecute firearm owners.
I think mainly they use empty brass as their excuse to look for other things they can prosecute for.
I've heard stories about people being prosecuted for an empty case rolling around the car floor, but I haven't seen an actual example of this sort of prosecution, it's usually a minor addition to larger primary charges.
My interpretation is simple English, and I'm quite confident that cartridge cases are never discharged _from_ firearms.

Do bikie gangs really collect their spent casings after drive by shootings. And then reload them.
The legislation specifically targets sporting shooters. And exactly nobody else.

Absolutely, none of it has anything to do with public safety.

WA Police Union declared years ago that licenced firearm owners are a health and _safety_ issue for its members, Police officers _feel_ threatened by other people owning firearms - we are the issue, not our guns.
I'd like to know how many times WA Police have been targeted by licenced firearm owners. I'm sure it happens, but it happens less often than Police have their own firearm accidents. I saw the sand-filled clearing barrel at Kensington Police station front desk when it had half a dozen bullet holes in it in 2010. I can only hope they wait until the foyer is clear before allowing them to clear their weapons to enter the station.

I think it's a myth, or perhaps it's been used when they really wanted to nail some nasty piece with something after forcing an otherwise fruitless search of their vehicle, just to save their own egos. Whether anybody has been convicted for it in isolation I have no idea, but I doubt it. I'd love to know if it's been used as an excuse for an illegal search, that did find good evidence for a case but then got thrown out because it was used illegally to make the search.

Have they added a few bullet holes for every police station on that map ?

I'd like to see the data that supports the theory that licenced firearms owners are a threat to the community.

so, it turns out ( from shooters union) that the pictorial reference above from that paper is actually ACCURATE, those are the actual houses containing firearms... WTF ... just released personal info to crims on where firearms are stored...

bet they were hoping the crims will steal a few and it will be easier to use the excuse " public safety " to push these bs laws through...

Who comes up with this stuff?? Are they are simply trying to make it so hard everyone gives up?....... Trouble is, the actual problems don't go away, as violent people with no morals will still find a way to be violent people with no morals. I suspect none of this regulation will make a scrap of difference....... It's just the every day honest people who get screwed over and lose a nice hobby.....

It's all about appearing to be doing something without doing anything at all.
There's a long running history of the public service WAPOL treating the people it serves with contempt.
The article in the West Australian is appalling, I hope everyone has taken the time to read it. The problem with rubbish like that article is the average Joe ends up believing it even in the absence of actual data to support the claims being made.
Perhaps someone with a good knowledge of the WA firearms act can chime in with the current safe storage and fit / proper person ruled because that seems to be the nuts and blots of the article.

It has been revealed the number of unlicensed knives in the state had soared by 60 per cent, with dozens of knife owners on every suburban street.
Baseball bats, house bricks and bottles are also being amassed in alarming numbers across the state.

Quote from WA Today. “There is something like 350,000 firearms out there, a hell of a lot of them are publicly lying around, mostly unused, if not all, in a state that is very attractive for a criminal to steal,” he told Radio 6PR.”

Can someone from WA point out what area’s these “publicly lying around” firearms are in? I’ve been driving around all day and stuffed if I can find any.
