Legal question about weapons change-overs...

Post by TikkaT3.223 » 19 Sep 2014, 5:32 pm

Hey guys. A bit of a touchy subject for me at the moment.

My fiance and I are going through some troubles at the moment, and she just got her license in the mail (in half the time it took to START processing mine), and I was wondering if I put my gun on her license until I got mine, if she decided to be a gigantic pain in my ass and leave with it, what can I do?

If it matters, I've paid $3000 for my gun and ive paid for both of our licenses and the safety courses.

Once it's in her name it's legally hers. If you think it's on the rocks I'd just wait for your licence to come back mate

You dont own a gun until you've got your licence, got the PTA, and the dealer has registered to you....it an offence in most parts of this land to 'own' a firearm without a licence, so I wouldnt even claim owning one until you've got the licence in your hot little hand (or a receipt)

Just leave it with your dealer until the time, legally, as you're well aware no doubt until you have the licence you can not possess carry etc even if registered in her name... patience.

She got her license in her hand after 7 weeks, and i put her application in WEEKS AFTER mine. This is my 15th or 16th week in waiting. I should've had my license way before her. That's what I don't understand. Logically, I shouldn't be having this problem, IMHO.

This thread is throwing up some red flags, but anyway.

I'd go with patience on this one. My license was supposed to be back but it got lost in transit. Finally I got the application back, put it all in a new envelope and sent it off via registered mail. I'm about 10 weeks behind where I want to be, but I wouldn't do anything illegal to get my hands on a gun any sooner than I was allowed.

Leave it at the GS until you have your license, PTA etc and play it safe.

IMHO

You have been posting about your history remember??
Honestly/realistically, you will be lucky if they issue you a licence.
Patience.

Yeah from when I put my application in it was over 18 months until I saw a licence and I've got a clean record so patience is key

Best of luck with the relationship mate. It sucks when they go south.

As stated, once the gun in transferred to hers it's hers. She's responsible for keeping, storing, blah blah... You would have to transfer it back to you as the owner if you split, assuming your license comes in.

I'm sure you won't do anything stupid but just so it's said... Obviously the last thing you want to do is have her own it on paper but be using it as if it's yours should your license fall through. If you transferred it to her name and she brought it home but you had access to the safe etc. before your license came through, that would get you in deep do-do. Criminal charges for both of you.

Best of luck with it all friend.
